The primary purposes for collection, storage and/or use of your Personal Information include, but are not limited to:

4.1 Human Resources Management. We collect, store, analyse, and share (internally) Personal Information in order to attract, retain and motivate a highly qualified workforce. This includes recruiting, compensation planning, succession planning, reorganization needs, performance assessment, training, employee benefit administration, compliance with applicable legal requirements, and communication with employees and/or their representatives.

4.2 Business Processes and Management. Personal Information is used to run our business operations including, for example, scheduling work assignments, managing company assets, reporting and/releasing public data (e.g., Annual Reports, etc.); and populating employee directories. Information may also be used to comply with government regulation.

4.3 Safety and Security Management. We use such Information as appropriate to ensure the safety and protection of employees, assets, resources, and communities.

5. DISCLOSURE OF DATA

5.1 We act to protect your Personal Information and ensure that unauthorized individuals do not have access to your Information by using security measures to protect Personal Information. We will not knowingly collect or use Personal Data in any manner not consistent with this Policy, as it may be amended from time to time, and applicable laws.

5.2 La Niche will not use your information for any purpose other than to complete a transaction with you. La Niche does not rent, sell or share your personal information and will not disclose any of your personally identifiable information to third parties.

5.3 For the use of the Platform and purchase of products, you may be required to pay La Niche with a credit card, wire-transfer, or debit card through La Niche’s third party payment gateway provider and such third party payment gateway provider may be required to collect certain financial information from you including, but not restricted to, your credit / debit card number or your bank account details (collectively referred to as “Financial Information”). All Financial Information collected from the Users’ by La Niche’s third party payment gateway providers will be used only for billing and payment processes. The verification of the Financial Information shall be accomplished only by the User through a process of authentication in which Financial Information shall have no role to play.

5.4 The Financial Information collected from the Users is transacted through secure digital platforms of approved payment gateways which are under encryption, thereby complying with reasonably expected technology standards. While La Niche shall make reasonable endeavours to ensure that the User’s Personal information and the Financial Information is duly protected by undertaking security measures prescribed under applicable laws, the User is strongly advised to exercise discretion while providing personal information or Financial Information while using the Platform given that the internet is susceptible to security breaches.

5.5 All information collected from the Users by La Niche is maintained in electronic form on servers and / or cloud systems and shall be accessible by certain employees of La Niche. The User information may also be converted to physical form from time to time. Regardless of the manner of storage, La Niche shall make commercially reasonable endeavours to ensure that the User information is rendered confidential, and will disclose User information only in accordance with the terms of this Policy.

5.6 We will not knowingly disclose, sell or otherwise distribute your Personal Information to any third party without your knowledge and, where appropriate, your express written permission, except under the following circumstances:

5.8 The User consents to La Niche reproducing / publishing all testimonials and reviews given by the User (whether on the website, social media platforms, or in any other manner whatsoever) in relation to La Niche or any of the products, together with the User’s name and location, on the Platform, on such page and in such position as La Niche may determine in its sole discretion. The User agrees that La Niche may edit the testimonials and reviews provided by the User and reproduce / publish such edited or paraphrased versions of the testimonials and reviews on the Platform. 7.8 La Niche follows all security norms, hence mode of payment made by the User is secured.

7.9 La Niche seeks to comply with the practices and procedures as prescribed under the Information Technology Act, 2000 and the rules thereunder to secure your Personal Information.

7.10 By accepting the terms of this Policy, you agree that the standards and practices being implemented by La Niche, are reasonable and sufficient for the protection of your Personal Information.

8.DURATION

8.1 The Personal Information provided by you shall not be retained by La Niche for longer than it is required for the purposes for which it was processed in accordance with legal, regulatory, contractual or statutory obligations as applicable.

8.2 At the expiry of such period your Personal Information will be deleted or archived in compliance with applicable laws.

8.3 The Personal Information of the Users is only collected when it is for a lawful purpose in connection with the function or activity carried out by La Niche and when the collection of such Personal Information is considered to be necessary for La Niche’s purpose.

9. RIGHTS OF USERS

9.1 You may have certain rights relating to your Personal Information provided for under applicable laws of India.

9.2 These are the rights to: Request access to your Personal Information and request details of the processing activities conducted by La Niche, including, but not limited to:

10.1By providing information to La Niche, you, hereby specifically grant consent to La Niche to collect and save your Personal Information. You further consent to use your Personal Information for future opportunities.

10.2As per the applicable data protection laws in India, your consent will not be taken in situations where your Personal Information is to be shared in pursuance of adhering to a legal obligations.

11. REVOCATION OF CONSENT

11.1The providers of the Personal Information, prior to the collection of information will be given an option to not provide the data sought to be collected.

11.2The providers of information also have the option to revoke their consent at any time during which they are availing our services.

12. UPDATING AND ACCESSING YOUR PERSONAL DATA

12.1You have the opportunity to keep your Personal Information accurate and up-to-date.

12.2You must promptly inform us when changes occur in the Personal Information you have provided so that we can maintain accurate Information about you. Although you may update or change your Information, we may maintain such Personal Information previously submitted in historical archives.

15.1No personal information is automatically collected from any visitors of the Platform who are merely perusing or browsing the Platforms (“Visitor”). Nevertheless, the provisions of this Policy are applicable to Visitors, and Visitors are required to read, understand and accept the privacy statements set out herein, failing which they are required to leave the Platform immediately.

15.2A User will not merely be a Visitor if the User has willingly submitted any personal information (including phone numbers, email addresses, responses to surveys, etc.) to Us through any means, including email, telephone calls, telephonic messaging or while availing or signing-up for the services.
